Published Appellate Decision

Kaney v. Custance (2022) 74 Cal.App.5th 201. Babak drafted the appellate briefs and argued the appeal in this premises liability case. The Court of Appeal reversed a grant of summary judgment for the defense and certified the opinion for publication. The court held that a plaintiff who does not remember the fall can still establish causation through circumstantial evidence. Read the opinion.

$9,667,636.15 jury verdict Mairs v. Morris, et al., San Bernardino County, Case No. CIVDS1517737. The defense’s last offer before trial was $100,000 and the plaintiff’s last demand was $1,000,000. The jury’s award to a 71-year-old client covered a lumbar surgery and future pain management.
$3,796,795.83 jury verdict Martinez v. Alpha Electric AC/DC, Inc., et al., Riverside County, Case No. RIC2000853. A three-car collision in which the client was rear-ended and pushed into the vehicle ahead. The defense argued it was a minor impact with a sprain or strain that should have resolved within weeks. The client underwent a one-level disc replacement.

Settlements

$23,000,000 settlement Sanchez v. City of Long Beach, et al., Los Angeles County, Case No. BC689551. A dangerous road design case on behalf of a six-year-old pedestrian with catastrophic injuries from a vehicle crash. The case settled in the days before trial.
$6,300,000 settlement Jennings v. WinCo Foods, et al., Riverside County, Case No. RIC1824807. A premises liability case in which a store clerk lost control of a cart caddy and struck the client with a row of shopping carts.
