Often you do not. If nobody was hurt, the other driver’s insurer has accepted fault, and the dispute is only about repairing a vehicle, hiring a lawyer usually adds cost without adding value. The picture changes when there is an actual injury, when fault is disputed, when a government entity or a commercial vehicle is involved, when the at-fault driver is uninsured, or when an adjuster has asked for a recorded statement or a blanket medical authorization. This page tries to describe both situations accurately rather than argue for one.
We are B&D Injury Law Group, and our team handles injury claims across California and in Las Vegas, Nevada. We turn down cases that do not need us, and we would rather explain the line honestly than persuade someone into representation they do not need. Below: when a person can reasonably handle a claim alone, the specific situations where doing so tends to go badly, how contingency fees are regulated in California, and the deadlines that end the question regardless of what you decide.
When You Probably Do Not Need a Lawyer
There is a real category of claim that people handle well on their own, and it has recognizable features.
Nobody was injured, or an urgent care visit resolved it completely with no ongoing symptoms. Liability is not in dispute, usually because the other driver was cited or their insurer has accepted responsibility in writing. The only question is property damage, which is a comparatively mechanical exercise: repair estimates, a valuation if the vehicle is a total loss, a rental car, and possibly a diminished value claim.
In that situation the value of representation is limited, because most of what a lawyer adds is leverage on disputed questions, and there is no disputed question. A contingency fee on a property damage recovery would take a share of money you were likely to collect anyway.
Two cautions even here. Do not sign a general release while you still have any symptom you have not had evaluated, because a release resolves the injury claim as well as the property claim and cannot usually be undone. And be careful about accepting a total loss valuation without checking comparable sales yourself; the first figure is an opening position.
When Handling It Alone Usually Goes Badly
Several situations reliably produce worse outcomes for unrepresented claimants, mostly because of deadlines and procedural traps rather than negotiating skill.
A public entity is involved. If the other vehicle belongs to a city, county, transit agency or school district, or the crash involved a dangerous condition of public property, Government Code section 911.2 requires a written claim presented to that entity within six months. Not two years. Six months, and it runs while you are still in treatment. Missing it generally ends the case against the government.
There is a genuine injury with ongoing treatment. Once a claim involves future care, permanence, or lost earning capacity, valuation stops being arithmetic. Settling before the medical picture is stable means guessing, and the guess is final.
Fault is disputed or shared. California uses pure comparative fault under Li v. Yellow Cab Co. (1975), so responsibility gets divided by percentage. An insurer asserting that you were 40 percent responsible is making an argument that costs you 40 percent of everything, and it is cheap for them to assert.
The at-fault driver is uninsured or underinsured. That turns the claim inward against your own uninsured motorist coverage, which is a contract claim against your own insurer with its own notice requirements, and Insurance Code section 11580.2(f) sends any disagreement over whether you can recover, or how much, to arbitration.
A commercial vehicle, a rideshare, or an employer is in the picture. These bring layered policies, corporate defendants, and evidence such as telematics and driver logs that must be preserved through a written demand before it is overwritten on the ordinary retention schedule.
Someone has asked you for a recorded statement or a blanket medical authorization. Neither is required by law when the request comes from the other driver’s insurer, and a broad authorization opens your entire medical history rather than the records relevant to this crash.

What a Lawyer Actually Does on a Claim Like This
It is worth being concrete, because the value is not mysterious and it is not universal.
The work is preserving evidence that is disappearing, identifying every defendant and every policy that could respond, keeping the medical record coherent and complete, calculating future care and lost earning capacity with support rather than assertion, handling liens so a settlement is not consumed by repayment claims after the fact, and taking the case far enough into litigation that the other side’s valuation has to change.
That last point is the honest core of it. Much of the leverage in an injury claim comes from a credible willingness to file and try the case. An unrepresented claimant is negotiating without it, which is why the same file is frequently valued differently depending on who is holding it.
None of this argues that everyone needs a lawyer. It argues that the value scales with how much is actually in dispute.
How Contingency Fees Work in California
In an injury case the fee is normally contingent, meaning it is a percentage of the recovery and there is no fee if there is no recovery. California regulates these agreements specifically.
Business and Professions Code section 6147 requires the attorney to give the client a signed duplicate copy of the contract at the time it is entered into. That contract must state the contingency fee rate agreed upon, how disbursements and costs will affect the fee and the client’s recovery, the extent to which the client could be required to pay compensation for related matters, and, unless the case falls under the medical malpractice fee limits in section 6146, a statement that the fee is not set by law but is negotiable.
That last requirement is the one worth reading twice. The rate is negotiable as a matter of statute, and the agreement has to tell you so. If an attorney fails to comply with section 6147, the agreement is voidable at the client’s option and the attorney is then entitled only to a reasonable fee.
Costs are separate from fees, and how they are handled is where agreements differ most. Ask whether the percentage is calculated before or after costs are deducted, because on the same settlement the two produce materially different outcomes for you.

The Deadlines That Decide It for You
Whatever you decide about representation, the clock is not negotiable.
The general California deadline for a personal injury lawsuit is two years from the date of injury under Code of Civil Procedure section 335.1. For property damage alone it is three years under section 338. Where a public entity is a defendant, the six-month written claim requirement in Government Code section 911.2 comes first, and missing it usually ends the claim unless a late-claim application under Government Code section 911.4 is granted.
For an injured child, Code of Civil Procedure section 352(a) tolls the limitations period during minority, with public-entity claims the significant exception.
If you are close to any of these dates and undecided, that is itself the answer to whether to talk to someone. A case evaluation with our firm is free, and a missed deadline often cannot be repaired.
Frequently Asked Questions
Do I need a lawyer for a minor car accident with no injuries?
Usually not. Where nobody was hurt, liability is accepted, and the only issue is vehicle repair or total loss valuation, most people handle the claim themselves without disadvantage. The main caution is to avoid signing a general release while any symptom remains unevaluated, because a release typically resolves the injury claim too and cannot easily be undone.
What does a car accident lawyer cost in California?
Injury cases are normally handled on contingency, so the fee is a percentage of the recovery and there is no fee without one. Business and Professions Code section 6147 requires a signed duplicate copy of the written agreement stating the rate, how costs affect the fee and your recovery, and, outside the medical malpractice fee limits in section 6146, that the fee is not set by law but is negotiable. Non-compliance makes the agreement voidable at the client’s option.
Should I give the other driver’s insurance company a recorded statement?
You are not required to give one to the other driver’s insurer, and there is rarely an advantage in doing so early. The same applies to a blanket medical authorization, which opens your full medical history rather than the records related to this collision. Your own insurer’s policy may impose cooperation duties, which is a different question.
How long do I have to file a car accident claim in California?
Two years from the date of injury for personal injury under Code of Civil Procedure section 335.1, and three years for property damage under section 338. If a public entity is involved, Government Code section 911.2 requires a written claim within six months before suit, which is the deadline most often missed.
Is it too late to get a lawyer if I already started the claim myself?
Usually not, provided the deadlines have not run and you have not signed a release. What cannot be undone is a signed release or an expired limitations period. Recorded statements and early valuations can generally be worked with, so if you are partway in and it has become adversarial, that is a reasonable point to get an opinion.
